Dear Chabot Swim Club Membership,

We have just a week left to trade in bands.  I met so many nice people through this trade in process.  Your patience, kindness and support while we work through this difficult time is really appreciated.  I know some people are reading ulterior motives into the wristband trade in. But, truly we are trying to do what is right for the membership at large.  It's an unfortunate situation that requires immediate action to protect the assets of Chabot Swim Club.

While there is nothing in the bylaws that says that bands are not transferable, and in the past it hasn't been a problem.  However, it does state in Article II: Purpose, Section 1. "This club is not organized for business purposes nor pecuniary profit and no part of the net earnings thereof shall inure to the benefit of any member or individual, but shall inure exclusively to the benefit of the club."  Selling wristbands constitutes pecuniary profit to a member or former-member. Purchasing bands for less than the stated price from the club constitutes a pecuniary profit to the purchaser in that there is a benefit of saving real money off the club purchase price.

There is no real way to keep former members from selling bands at a discounted price.  We believe most members had no ill intention when purchasing wristbands from a former member.  Unfortunately, this offer to sell old wristbands came at the same time that the 2,000 missing bands started showing up in large quantities for parties at the club. To protect the Chabot Swim Club assets, we must make these old wristbands obsolete.  To do that we purchased a colored band that is different from all other past bands to trade for members' old wristbands. We know long time members have many old bands in their possession. We do not wish to short anyone out of previously owned bands.  We are attempting, however, to eliminate the ability of someone to further sell or give away the 2,000 missing bands at a real monetary loss to Chabot Swim Club.

Before I was treasurer I really didn't understand how the revenue generated from wristband sales helps pay for extra guards' salaries, PG&E, water, garbage, pool chemicals, bathroom supplies, and cleaning supplies incurred by parties.  Multiple large parties on the same day adds even more cost of these things. Wristband sales help pay for those additional costs. A party of 30 non-members could generate $150. Just one extra guard to staff a day with multiple parties costs approximately $120.  This summer we have members having multiple parties nearly every Saturday and Sunday throughout the entire season, and many of those members say they don't need to buy wristbands. Without that wristband revenue we have to take that money from savings. This year we all paid the one-time Capital Improvement Fee of $200 to help pay for the re-plastering of the pool.  We discovered in May that we have a significant leak in the pool that will need to be repaired at the time of re-plastering. The leak repair and re-plastering is going to cost the pool around $100,000. The $200 one-time Capital Improvement Fee per member we collected amounts to around $40,000. We will have to take the remainder out of the club savings. If we have to take money out of that $40,000 one-time fee revenue, or savings, to pay for the extra costs generated by multiple parties, then we may find that we are short the $100,000 we need for repairs and re-plastering.  This potential problem weighs heavily on the board. The pool is our number one asset. Without it being in good working condition, we have no pool. Without a pool, we have no club. The Chabot Swim Club has been an asset to the community around it, and it's members, for 60 years. As a board, we are charged with the responsibility of seeing it continue to be an asset to the community and all its members.

It was not an easy decision to do a wristband trade in.  It cost over $300 in new wristbands, and will take numerous hours of Board volunteer time to get it done.  However, with 2,000 missing wristbands and a potential loss of $10,000, we had to take action. We as a board do not benefit in any way in doing this, our only goal is in preserving the Chabot Swim Club's assets for its members.  Your support and understanding is greatly appreciated as we go through this process.

Thank you,

Tracie Kinser
